Privacy Policy

1. Who Exclusive is
Exclusive Insurance Services Limited ("Exclusive", "we", "us", "our") is an insurance broker regulated in New Zealand under the Financial Markets Conduct Act 2013 as a Financial Advice Provider (FSP70801). Our head office is The Formery, Suite 5, Level 1, 87 Albert Street, Auckland Central 1010.
This Privacy Policy explains how we handle personal information collected from and about you.
2. Information we collect
We collect the personal information reasonably necessary to provide broking and related services, which may include:
- identity and contact details (name, business name, address, phone, email);
- information relevant to the risk being insured (business activities, assets, revenue, claims history, occupation, health information where a personal cover is arranged);
- correspondence, notes of conversations and instructions;
- information required to comply with law (e.g. anti-money-laundering identity checks where applicable); and
- technical information collected automatically when you use our website (see Section 8).
3. Direct collection
We usually collect personal information directly from you — for example when you complete a form, request a review, provide claim details, or communicate with us by phone or email.
4. Information obtained from other sources (IPP 3A)
Where permitted by the Privacy Act 2020 and consistent with information privacy principle 3A, we may also collect information from other sources when it is not reasonable or practicable to collect it directly from you, or where you have authorised us to do so. Sources may include:
- insurers, underwriters and reinsurers involved in your cover;
- previous brokers and adviser records provided under a letter of appointment;
- loss adjusters, investigators and legal advisers appointed in relation to a claim;
- publicly available registers (e.g. Companies Office, Motor Vehicle Register) where relevant to the risk; and
- credit reporting or verification services where required to establish identity or eligibility.
5. Purposes of collection and use
We use personal information to:
- assess your insurance needs and structure appropriate cover;
- obtain quotations from and place cover with insurers;
- administer policies (endorsements, renewals, cancellations);
- manage claims on your behalf;
- respond to your enquiries and provide client service;
- meet legal, regulatory and industry-standard obligations; and
- improve our services (including through analytics on our website).
6. Recipients and disclosures
We may disclose personal information to:
- insurers, reinsurers, underwriting agencies and other intermediaries involved in arranging or managing your insurance;
- service providers who assist us (e.g. IT, email delivery, document generation, claims administration, professional advisers);
- the Steadfast broker network and its facilities where relevant;
- loss adjusters, investigators and legal advisers in relation to a claim;
- regulators, dispute-resolution schemes and other authorities where required by law; and
- any successor to our business.
7. Overseas service providers and safeguards
Some of our service providers (for example email delivery and cloud infrastructure) are located outside New Zealand. Where we transfer personal information overseas, we take reasonable steps to ensure it is protected by comparable safeguards, including contractual protections and reliance on jurisdictions that provide comparable privacy protections. On request we can identify the jurisdictions where information may be held.
8. Cookies, analytics and online services
Our website uses cookies and similar technologies to operate essential functions, remember preferences and understand aggregate usage. We use analytics tools that may set cookies. Where required, we obtain your consent for non-essential cookies. You can control cookies via your browser settings.
9. Storage and security
Personal information is held in electronic systems operated by us or our service providers. We take reasonable steps to protect it against loss, misuse, unauthorised access, modification and disclosure — including access controls, encryption in transit, staff training and vendor due diligence.
10. Retention and disposal
We keep personal information only for as long as reasonably required for the purposes for which it was collected, or as required by law (including record-keeping obligations that apply to insurance intermediaries). When no longer required, it is destroyed or de-identified.
11. Access and correction rights
You have the right to request access to, and correction of, personal information we hold about you. Requests should be sent to our Privacy Officer using the contact details in Section 13. We will respond within the time frame required by the Privacy Act 2020.
12. Privacy breaches
If a privacy breach occurs that is reasonably likely to cause serious harm, we will notify affected individuals and the Office of the Privacy Commissioner as required under the Privacy Act 2020.
